A Brooklyn Landlord refused to renew a rent-stabilized tenant's lease based on the Landlord's allegation that the Tenant, a resident of 37 years, and her daugher were not occupying the subject premises as their primary residence. After trial the court dismissed the Landlord's case with prejudice and concluded that the Petitioner did not meet his burden of proof by a preponderance of the evidence that the Tenant failed to maintain a pysical nexus at the subject residence that was ongoing and substantial.
